1. General definitions and effective date

These terms and conditions take effect from ….. between KARPIRA International Recruitment Agency (the agent) and the employer (the client) for introductions arranged for employment in the [destination country].

2. Variation

No variation of these terms is valid or shall be binding on the agent unless confirmed in writing by a director of the agent.

3. Payment

All fees and charges are payable within 30 days of the date of invoice and payment should be made to KARPIRA International Recruitment Agency. If payment is not made within 28 days of the invoice date the agent shall be entitled to charge interest thereon from the date of the invoice until the date of payment.

4. Candidate

Candidate means a person introduced to the client directly or indirectly by the agent. The word introduce shall be deemed to include (without limitation to the generality of the meaning) the provision by the agent to the client of any details whether written or oral of a candidate for engagement.

7. Confidentiality

Introductions are confidential and any information related to a candidate must not be based on to another employer or any other person without express agreement of the agent.

8. Notification

The client shall notify the agent immediately a candidate is engaged or an offer of employment is made.

9. Date of engagement

The date of engagement is a date that a candidate commences employment with the client or is engaged by the client in any capacity relating to the activity of the client.

10. Referral

If the client or a member of the client’s staff refers a candidate to some other employer or person and that other employer or person engages the candidate in any capacity whether temporary, permanent or self-employed, the client shall pay the fee as defined in clauses 14-17, at the date of notification or discovery by the agent.
